Updated MS4 General Permit to be Approved in January

The TCEQ is scheduled to approve the next five-year general permit (TXR040000) for Phase II (Small) MS4s on Jan. 16, 2019, and the permit will be issued a few days later. While the current five-year general permit is scheduled to expire Dec. 12, 2018, TCEQ has stated it will administratively extend the provisions of the current permit to provide continuous coverage until the effective date of the new permit. Regulated municipalities will have six months from the effective date of the renewed permit to develop and submit an updated Stormwater Management Program (SWMP) to TCEQ for review and approval. 

The revised permit will include several changes in requirements that affect Small MS4s across all operating levels. Key changes include:

  • Identification of clear, specific, and measurable annual goals
  • Development of standard operating procedures
  • Public notice and public reporting
