Public Water Utility Rates Transfer From TCEQ to PUC

As of September 1, 2014, the Public Utility Commission (PUC) of Texas will officially be handling all retail public utility water and wastewater rates, certificates of convenience and necessity (CCN) and sale transfer mergers (STM), which were previously handled by the Texas Commission on Environmental Quality (TCEQ). This was part of the Sunset Advisory Commission’s recommendation to the 83rd legislature to allow “TCEQ to focus on its core environmental mission while taking advantage of PUC’s historic ratemaking expertise.” 

Who may be affected? 

  • Investor-owned utilities 
  • Water supply corporations 
  • City and county-owned utilities
  • Wastewater utilities 
  • All parties interested in the policies, rates and operations of retail public or private water utility in Texas 

All pending applications relating to rate/tariff changes, STM applications, and CCN applications, as well as any pending applications being heard by the State Office of Administrative Hearings, will be transferred to the PUC.
